Terms of Service - VsD Against the Darkmaster

Acceptance of Terms

By accessing or using the VsD: Against the Darkmaster character management platform ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

You must be at least 18 years old to use this Platform. By creating an account, you confirm that you are 18 years of age or older. If we learn that an account belongs to someone under 18, we will terminate it.

Beta Program

The Platform is currently in public beta. This means:

The Platform is provided for testing and feedback purposes and is still under active development
Features may change, be added, or be removed without notice
The service may experience downtime, data loss, or unexpected behavior
We make no guarantee of uptime, stability, or data preservation during the beta period

We will make reasonable efforts to preserve your data, but we strongly recommend keeping your own backups of any character data that is important to you.

Your Account

To use the Platform you must create an account. You are responsible for:

Keeping your login credentials confidential
All activity that occurs under your account
Providing accurate information when creating your account
Notifying us immediately if you believe your account has been compromised

You may only create one account per person. Creating multiple accounts to circumvent a suspension or any other platform restriction is prohibited.

Your Content

You retain ownership of all character data and content you create on the Platform ("Your Content"). By using the Platform, you grant Open Ended Games, INC a limited license to store, display, and process Your Content solely for the purpose of providing the service to you.

We do not claim any ownership over your characters, stats, or any creative content you input. You can export or delete your content at any time.

Acceptable Use

You agree not to:

Use the Platform for any unlawful purpose
Attempt to gain unauthorized access to other users' accounts or data
Scrape, copy, or harvest data from the Platform by automated means
Interfere with or disrupt the Platform's servers or infrastructure
Impersonate any person or entity
Use the Platform to distribute spam or unsolicited communications
Reverse engineer or attempt to extract the source code of the Platform

Discord Integration

The Platform offers optional integration with Discord via the Darkmaster bot. Use of this feature is subject to Discord's Terms of Service in addition to these Terms. We are not affiliated with or endorsed by Discord.

Termination

By you

You may delete your account at any time through the Platform. Upon deletion, all your data will be permanently removed from our systems.

By us

We reserve the right to suspend or terminate any account that violates these Terms, engages in abusive behavior, or poses a security risk to the Platform or other users. We will make reasonable efforts to notify you before taking such action, except in cases of serious or repeated violations.

Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. Open Ended Games, INC does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. Use of the Platform is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, Open Ended Games, INC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of data, loss of profits, or loss of goodwill.

Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the twelve months preceding the claim. During the free beta period, this cap is $0.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of the State of New York.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page. For material changes, we will notify you via email if you have provided one. Continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.
